ZayTap POS Terms & Conditions

Please read these terms carefully before using ZayTap POS. By registering or using the service, you confirm that you understand and accept this service agreement.

Introduction

ZayTap POS is a modern Point of Sale system developed by HexTech for small, medium and growing businesses in Myanmar. It helps businesses manage sales, inventory, income and expense records, customer service and daily operations in a systematic way.

Important notice: Using ZayTap POS means the customer has read, understood and accepted these service terms.

01Definitions

  • Company means HexTech Software Solutions.
  • Product means ZayTap POS Mobile Application and related services.
  • Customer means the person or business registering and using ZayTap POS.
  • Account means the user account created for the customer.
  • Subscription means the paid service access for a monthly or specified period.

02About ZayTap POS

ZayTap POS is a cloud-based Point of Sale Management System created by HexTech for retail and sales businesses.

03Subscription Service

ZayTap POS can be used with subscription plans. Features may differ depending on the selected package.

HexTech may update packages, services and features when needed and will notify customers about important changes.

04Free Trial and Free Version

  • Customers may use a free trial or free version to test basic ZayTap POS functions.
  • Some features in the free version are limited and premium features require a subscription plan.
  • Data saved during the free version can continue to be used after upgrading to a paid plan.
  • HexTech may change free version features, usage period and rules when necessary.
  • HexTech is not responsible for business losses caused by use of the free version.

05Payment Terms

  • Customers must pay the monthly subscription fee according to the selected package.
  • Payment can be made by bank transfer, mobile banking, KBZPay, Wave Pay or other methods approved by HexTech.
  • Unpaid accounts may be limited or temporarily suspended.
  • Customers will be notified before subscription expiry. If renewal payment is not made, account access may be suspended.
  • Subscription fees are non-refundable after payment.

07Customer Responsibilities

  1. Provide correct business information.
  2. Keep username and password secure.
  3. Do not use the system for illegal business activities.
  4. Do not perform actions intended to damage the system.
  5. Do not share accounts with unauthorized persons.
  6. Do not reverse engineer, copy or resell the software.
  7. Notify HexTech quickly when technical issues occur.

08Data Privacy and Security Policy

HexTech takes special care to protect customer business data including product information, sales records, customer records, inventory data and business reports. HexTech will not sell or share customer data with third parties without permission, except when required by law.

09Data Backup Policy

Important customer business data is stored on a cloud server. Customers should also regularly export data, download reports and keep local backups. HexTech will make reasonable efforts to reduce data loss caused by technical issues.

10Technical Support Policy

  • Support services include user training, application setup, troubleshooting, account recovery, system guidance and software updates.
  • Support hours: Monday to Friday, 9:00 AM to 5:00 PM.
  • Support may be limited on public holidays.

11Service Suspension and Termination

HexTech may temporarily suspend or permanently terminate accounts in cases of unpaid subscription fees, violation of terms, illegal or fraudulent activities, or actions affecting system security. After termination, customer data will be retained only for the specified period.

12Limitation of Liabilities

HexTech is not responsible for business loss or profit loss caused by internet failure, power outage, customer device failure, natural disasters, third-party service failure, cloud provider issues, customer negligence or unauthorized access.

13Intellectual Property Rights

ZayTap POS software, mobile application, website, database structure, user interface design, logo, brand name and related technologies are the legal intellectual property of HexTech. Customers receive service usage rights only and do not receive ownership rights. Copying, reverse engineering, reselling or unauthorized trademark use is strictly prohibited.

14Force Majeure

HexTech will not be liable for service interruptions caused by uncontrollable external events such as natural disasters, war, civil unrest, government restrictions, cyber attacks, internet failure or power grid failure, but will make best efforts to restore services.

15Software Update and System Improvement

HexTech may continuously upgrade ZayTap POS to improve security and add new features. Services may be temporarily paused during maintenance windows when necessary, and customers will be notified in advance where possible.

16User Training and Onboarding

HexTech provides onboarding support such as account setup, product setup, inventory setup, sales workflow training and basic troubleshooting training so customers and staff can use the system effectively.

17Service Availability

HexTech aims to keep the service available 24 hours a day and 7 days a week. Temporary interruption may occur due to server maintenance, system upgrades or emergency maintenance, and HexTech will work to restore services as soon as possible.

18Customer Feedback and Suggestions

HexTech may use customer suggestions and product improvement ideas to improve the system, and is not required to provide separate compensation for such suggestions.

19Governing Law and Dispute Resolution

This agreement will be implemented according to the applicable laws of Myanmar. If a dispute occurs, both parties will first try to resolve it peacefully through negotiation. If negotiation fails, the decision of the relevant court will be followed.

20Changes to Terms and Conditions

HexTech may update these terms when necessary. Important changes will be announced through Facebook Page, email or app notification. Continued use after the announcement means the customer accepts the updated terms.
